What this is
This Listing Agreement is between you and Marc Labrie and any entity through which he operates the RangeAcre platform (together, “Operator,” “we,” or “us”). It applies each time you save or publish a listing on RangeAcre. It incorporates the Terms of Service and Privacy Policy of the same version. Publishing a listing is also your acceptance of this Agreement. We store that acceptance with your user id, version, time, IP address, and user agent.
Authority to sell
You represent and warrant that you are the owner of the property or that the owner has authorized you to offer it for sale on the terms you post. You will identify yourself truthfully. You will not list a property that is under contract in a way that forbids this advertisement, or that you are marketing only as an unlicensed broker would be forbidden to do in that state. RangeAcre does not review your authority and does not become your listing broker by hosting the page.
What you are responsible for
You are solely responsible for the description, price, acreage, parcel number, map pin, zoning, utilities, access, water and mineral rights, taxes, homeowners’ association information, financing claims, photographs, and video. You will not invent a feature. If you offer owner financing, you are responsible for complying with lending, usury, and disclosure laws that apply to you. The Operator does not verify any of it and makes no warranty, express or implied, about the property. The property and the listing are presented as-is.
You will comply with the Fair Housing Act and applicable state law in every word and photograph. You will not state a discriminatory preference.
Photographs and DMCA
You grant the Operator the license in the Terms to host and display the photographs and other media you upload, and you represent that you have that right. If a third party submits a credible copyright complaint, we may take the photo down without notice to you and without liability.
Inquiries
We will route buyer messages and offers to the email on your account and, if you have opted in, by text under the SMS Terms. We do not guarantee that a message will be delivered or that a buyer is serious or able to pay. You decide whether to share your phone number or email inside a thread. You will not use buyer information for unrelated marketing.
Indemnity
You will indemnify and hold harmless Marc Labrie and any entity through which he operates the RangeAcre platform (together, “Operator,” “we,” or “us”) from every claim arising out of the property or the listing, including claims about title, authority, condition, boundaries, environmental contamination, injury on the land, fair housing, consumer protection, or the content of your photographs. The limitation of liability and the arbitration agreement in the Terms, including the class-action waiver, apply to this Listing Agreement.
Law and severability
This Agreement is governed by California law. Venue and arbitration are as stated in the Terms: binding individual arbitration, with court venue in San Diego County, California for anything that proceeds in court. If a provision is unenforceable, the rest remains in effect. The Operator may remove a listing at any time. You may unpublish a listing at any time. Removal does not erase acceptances or records we are required to keep.
